Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Services

Digital Business Cards Direct provides digital networking solutions, including but not limited to the creation, hosting, and updating of digital business cards, AI-generated headshots, AI video headers, and enterprise branding services.

3. Purchases, Subscriptions, and Payments

  • Annual Service: Our standard plans (Basic, Standard, Video Pro) are billed as annual subscriptions. Payment covers the initial creation, secure hosting for one year, and unlimited content updates via our Client Portal.
  • Pricing & Fees: Prices are listed on our website and are subject to change. Any promotional waivers of setup fees apply only to the initial purchase unless otherwise stated.
  • Renewals: Unless canceled prior to the end of your billing cycle, your service will automatically renew for successive one-year terms at the then-current annual rate.

4. Turnaround Times and Deliverables

We strive to deliver your digital business card within the estimated timeframes provided at checkout:

  • Basic and Standard plans: Approximately 24 hours.
  • Video Pro plans: Approximately 48 hours.
  • Custom/Enterprise plans: Approximately 5 business days.
  • Note: Delivery times are estimates and commence once all required user materials (photos, logos, details) have been successfully submitted.

5. User Content and Responsibilities

You are solely responsible for the information, images, logos, and links you submit for your digital business card (“User Content”).

  • You represent and warrant that you own or have the necessary licenses and rights to use all User Content provided.
  • You agree not to submit content that is unlawful, offensive, discriminatory, or infringes on the intellectual property rights of others.
  • We reserve the right to refuse service or remove any digital business card that violates these guidelines.

6. AI-Generated Content

For tiers utilizing AI services (such as AI Headshot Generation and AI Video Headers):

  • Outputs are generated using advanced artificial intelligence based on the inputs and scripts you provide.
  • While we strive for high-fidelity and professional results, AI-generated content is provided “as is.” We do not guarantee exact likenesses or specific aesthetic outcomes beyond the parameters of the chosen tier.

7. Intellectual Property

While you retain all ownership rights to your personal User Content (your logos, personal photos, and contact info), Digital Business Cards Direct retains all intellectual property rights to the platform, code, proprietary designs, glassmorphism templates, interactive layouts, and custom-generated multimedia assets created by our team or AI tools.

8. Updates to Your Card

Your annual subscription includes unlimited updates to your contact information. Updates must be submitted through our secure Client Portal using the email address and phone number associated with your original order. We aim to process standard updates promptly to ensure your networking remains uninterrupted.

9. Limitation of Liability

In no event shall Digital Business Cards Direct, IT WebSmith Inc, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages. This includes without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

11. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease, and your digital business card will be taken offline.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
